Florida Hospital’s Doctor Credentialing Data Not Discoverable

Dr. David M. Feldbaum, a Florida-based vascular surgeon, recently lost his bid to force a hospital to release credentialing and peer review documents in a lawsuit over the loss of his clinical privileges. A state appeals court ruled that the materials are immune from discovery. Consequently, South Broward Hospital District does not have to turn over the documents to Feldbaum as they fall squarely within the types of information protected by the Sunshine State's peer review privilege. Moreover, the privilege cannot be waived.
