Emergency Physician Wins $26M in Wrongful Termination Suit
Dr. Raymond Brovont will collect $26 million in a wrongful termination lawsuit against doctor staffing firm EmCare. Three years ago, the emergency medicine physician filed a suit claiming he was fired after raising staffing concerns at Overland Park Regional Medical Center in Kansas. Brovont repeatedly warned that EmCare was staffing only one physician on the night shift to cover both the hospital's regular and pediatric emergency departments. A jury awarded Brovont $29 million in October 2018, which included $10 million in punitive damages against two EmCare subsidiaries. After applying punitive damages caps under Kansas law, a trial judge reduced the award to $13 million. Brovont appealed and argued that Kansas law should not apply because the staffing company is headquartered in Missouri, which has no caps. The Missouri Court of Appeals ultimately ruled in Brovont's favor, although the original award was reduced to $23 million, increasing to $26 million with interest.
